1. Information on how to enter and the Fernwood 3 Visit Pass received in connection with this promotion form part of these Conditions of Entry. Return of the completed entry card to the Promoter is deemed to be an acceptance of these conditions of entry.

2. The Promotion period commences on 1 July 2006 and closes when the last remaining 3 Visit Pass has been distributed by the Promoter. Passes will be distributed on a first come, first served basis and while stocks last.

3. This offer is open to female residents of Australia 18 years old and over who purchase new (or have purchased new on their behalf) a Kapoochi baby bag throughout the promotion period. Existing members of Fernwood Women’s Health Clubs, employees (and their immediate families) of the Promoter, or agencies, suppliers, retailers of Kapoochi products or companies associated with the conduct of this promotion, are ineligible to enter.

4. In order to take up the offer and receive a Fernwood 3 visit pass, an eligible entrant must:

   • Purchase new (or have purchased new on their behalf) a Kapoochi baby bag from an authorised Kapoochi retailer.

   • Complete the official entry form attached to the bag.

   • Post the completed entry form along with a copy of their receipt of purchase to Kapoochi Australia Fernwood Promotion, PO Box 119 Nambour Qld 4560.

   • Upon receipt of the completed entry form and copy of the purchase receipt by the Promoter, the Promoter will post a personally addressed Fernwood 3 Visit Pass to the address entered on the entry form.

5. This offer is limited to one Fernwood 3 Visit pass per Kapoochi customer irrespective of the number of Kapoochi bags purchased or entries received by the Promoter from an individual throughout the period of the promotion.

6. Each Fernwood 3 Visit Pass is valued at $45.00.

7. The value of the 3 Visit Pass is accurate at the date of printing. The Promoter accepts no responsibility for any variation in the value of the 3 Visit Pass after that date. The Fernwood 3 Visit Pass cannot be exchanged or redeemed for cash. The Promoter retains the right to substitute the 3 Visit Pass with a gift of the same or differing value.

8. All Fernwood 3 Visit Pass holders are expected to comply with the conditions of use printed on the reverse panel of the pass. Conditions include, but are not limited to; the requirement to complete a pre-activity questionnaire for health and safety purposes and; for safety reasons, observe any off limit areas that may be explained during the visit.

9. The Promoter reserves the right to validate and check the authenticity of entries and to disqualify any entrant for tampering with the entry process.

10. The Promoter and their associated agencies or companies accept no responsibility for lost, late, stolen, damaged or misdirected entries.

11. If for any reason this Promotion is not capable of running as planned, the Promoter reserves the right in its discretion to modify the terms of the promotion including the offer and these Conditions of Entry.

12. Any tax liability arising as a result of accepting any Fernwood 3 Visit Pass is the responsibility of the winner.

13. The Promoter will not be liable for any injury, loss or damage of any nature whatsoever (including but not limited to indirect or consequential loss) which is suffered or sustained as a result of or in connection with receiving, taking or using any Fernwood pass or gift received in relation to this promotion, except for any liability which cannot be excluded by law.

14. All claims and entries become the property of the Promoter. The Promoter requires your personal information in order to conduct the Promotion. If you do not provide the personal information requested then you will not be able to take part in the Promotion. Unless the entrant has elected to opt out using the check box provided on the entry card, the Promoter or its supplier (Fernwood Women’s Health Clubs) may use personal information for future marketing purposes. The Promoter may provide personal information relating to entrants to organisations that assist the Promoter with promotional, marketing, publicity and fulfilment services. An entrant may access and correct any personal information held by the Promoter, upon request to the Promoter.
